1. Acceptance

By creating an account or using the Torio mobile app (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

The App is operated by Shlomi Talala, based in Ashdod, Israel ("we", "us"). Contact: support@torioapp.com.

2. What the App does

Torio is a scheduling and customer-relationship tool used by service businesses (currently barbershops and salons; additional verticals may be added later) and their customers. Customers can book, view, reschedule, or cancel appointments and chat with the business. Owners can manage services, working hours, customers, broadcasts, and loyalty programs.

We provide the software. We are not a party to any appointment, are not responsible for the service performed at the appointment, do not process payments between customer and owner, and make no warranty about business owners listed in the App.

3. Eligibility

You must be at least 16 years old to use the App. By using the App you represent that you meet this age requirement.

4. Your account

• Sign-in is by phone-number one-time SMS code. You are responsible for the security of the phone number associated with your account.
• You agree to provide accurate name and contact information and to keep it current.
• You may not impersonate another person or business.
• You may delete your account at any time from Settings → Account → Delete account. Deletion is irreversible (see the Privacy Policy for what is retained for accounting purposes).

5. Acceptable use

You will not:

• Use the App for any unlawful purpose;
• Harass, threaten, or harm another user;
• Spam, scrape, or interfere with the App's normal operation;
• Attempt to reverse-engineer, decompile, or extract source code from the App, except where permitted by mandatory law;
• Transmit malware or any content that infringes intellectual property or privacy rights;
• Use the App to send unsolicited marketing (including via the broadcast feature) to customers who have not consented to receive it.

We may suspend or terminate your account, without notice, if you violate these Terms.

6. Bookings

• An appointment booked through the App is a request to the business, not a confirmed reservation, unless the business has enabled auto-approval.
• The business decides whether to approve or reject the request.
• Cancellation rules (including any cutoff window) are set by the business and shown in the booking flow.
• Loyalty rewards are administered by the business; the App tracks visit counts and surfaces redemption-ready state. The reward itself is between you and the business.

7. Owner content

If you are a business owner, you alone are responsible for all content you publish in the App: business name, description, address, photos, services and prices, working hours, portfolio, products, and broadcasts. You confirm that you have all necessary rights to publish this content and that it is accurate, lawful, and respectful.

You grant us a limited, non-exclusive licence to display this content in the App and on related public pages (such as the customer-facing business preview) for the purpose of operating the service.

8. Notifications

By enabling notifications you agree to receive push messages from the App. You can disable individual categories at any time in Settings → Notifications. Operating-system level notification permissions are managed by your device's own settings.

SMS one-time codes for sign-in are required for the App to function; disabling SMS will prevent you from logging in.

9. Service availability

We aim to keep the App available 24/7 but do not promise uninterrupted or error-free operation. We may suspend or modify the App for maintenance, security, or technical reasons.

10. Intellectual property

The App, its source code, design, branding, and all related materials are owned by Shlomi Talala and protected by applicable copyright, trademark, and other laws. These Terms do not transfer any rights to you other than the limited right to use the App as described.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED 100 USD OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, or damage arising out of your breach of these Terms or your misuse of the App.

14. Governing law and venue

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the competent courts of Tel Aviv, Israel, unless mandatory consumer-protection law in your country requires otherwise.

15. Changes

We may update these Terms. Material changes will be announced in-app at next launch. Continued use after the update means you accept the revised Terms.

יצירת חשבון או שימוש באפליקציית Torio (להלן "האפליקציה") מהווים הסכמה לתנאי שירות אלה ("התנאים"). אם אינך מסכים — אין להשתמש באפליקציה.

האפליקציה מופעלת על ידי שלומי טללה, מאשדוד, ישראל ("אנחנו"). יצירת קשר: support@torioapp.com.

2. מה האפליקציה עושה

Torio היא כלי ניהול תורים ומועדון לקוחות עבור עסקי שירות (כיום מספרות וסלוני יופי; ייתכן שיתווספו ורטיקלים בעתיד) ולקוחותיהם. לקוחות יכולים לקבוע, לראות, להזיז או לבטל תורים ולתקשר עם העסק. בעלי עסק יכולים לנהל שירותים, שעות פעילות, לקוחות, הודעות לכלל הלקוחות ותכנית נאמנות.

אנחנו מספקים את התוכנה. אנחנו לא צד בתור עצמו, לא אחראים על השירות שמסופק בתור, לא מעבדים תשלומים בין לקוח לעסק, ולא נותנים אחריות לגבי בעלי עסק המופיעים באפליקציה.

3. כשירות

יש להיות בגיל 16 לפחות כדי להשתמש באפליקציה. השימוש מהווה הצהרה שאתה עומד בדרישת הגיל הזו.

4. החשבון שלך

• ההתחברות מתבצעת בקוד SMS חד-פעמי. אתה אחראי על האבטחה של מספר הטלפון המקושר לחשבון.
• אתה מתחייב לספק שם ופרטי קשר נכונים ולעדכן אותם כשהם משתנים.
• אסור להתחזות לאדם או עסק אחר.
• אפשר למחוק את החשבון בכל זמן דרך "הגדרות → חשבון → מחק חשבון". המחיקה בלתי הפיכה (ראו את מדיניות הפרטיות לגבי מה נשמר למטרות הנהלת חשבונות).

5. שימוש מקובל

אתה לא תעשה:

• שימוש לא חוקי באפליקציה;
• הטרדה, איום או פגיעה במשתמש אחר;
• ספאם, scraping או הפרעה לפעולה התקינה של האפליקציה;
• ניסיון לבצע הנדסה לאחור, decompile או חילוץ קוד מקור מהאפליקציה, אלא במידה המותרת על פי דין כופה;
• שליחת תוכנות זדוניות או כל תוכן המפר זכויות קניין רוחני או פרטיות;
• שימוש באפליקציה לשליחת שיווק לא מבוקש (כולל באמצעות תכונת "הודעה לכולם") ללקוחות שלא הסכימו לקבל אותו.

אנחנו עשויים להשעות או לסיים את החשבון שלך, ללא הודעה מוקדמת, אם תפר את התנאים.

6. תורים

• תור שנקבע באפליקציה הוא בקשה לעסק ולא הזמנה מאושרת, אלא אם העסק הפעיל אישור אוטומטי.
• העסק מחליט אם לאשר או לדחות את הבקשה.
• כללי ביטול (כולל חלון ביטול) נקבעים על ידי העסק ומוצגים בתהליך קביעת התור.
• תגמולי נאמנות מנוהלים על ידי העסק; האפליקציה סופרת ביקורים ומסמנת מתי מגיע התגמול. התגמול עצמו הוא בין הלקוח לעסק.

7. תוכן של בעלי עסק

אם אתה בעל עסק, אתה לבדך אחראי על כל התוכן שאתה מפרסם באפליקציה: שם העסק, תיאור, כתובת, תמונות, שירותים ומחירים, שעות פעילות, תיק עבודות, מוצרים והודעות. אתה מאשר שיש לך את כל הזכויות הנדרשות לפרסם את התוכן ושהוא מדויק, חוקי ומכבד.

אתה מעניק לנו רישיון מוגבל, לא בלעדי, להציג את התוכן הזה באפליקציה ובדפי הצפייה הציבוריים הקשורים (כמו הצפייה הלקוחית בעסק) למטרת הפעלת השירות.

8. התראות

הפעלת התראות מהווה הסכמה לקבל הודעות push מהאפליקציה. ניתן לכבות קטגוריות בנפרד בכל זמן ב"הגדרות → התראות". הרשאות התראה ברמת מערכת ההפעלה מנוהלות בהגדרות המכשיר עצמו.

קודי SMS חד-פעמיים להתחברות הם תנאי הכרחי לתפעול האפליקציה; חסימת SMS תמנע ממך להתחבר.

9. זמינות השירות

אנחנו שואפים שהאפליקציה תהיה זמינה 24/7 אבל לא מתחייבים לפעולה רציפה או נטולת שגיאות. ייתכן שנשעה או נשנה את האפליקציה לצרכי תחזוקה, אבטחה או טכניים.

10. קניין רוחני

האפליקציה, קוד המקור שלה, העיצוב, המיתוג וכל החומרים הקשורים הם בבעלות שלומי טללה ומוגנים על פי חוקי זכויות יוצרים, סימני מסחר ודינים אחרים. התנאים אינם מעבירים אליך כל זכות מעבר לרשות המוגבלת להשתמש באפליקציה כמתואר.

11. הסתייגויות

האפליקציה מסופקת "כמות שהיא" ו"כפי שזמינה", ללא אחריות מכל סוג, מפורשת או משתמעת, כולל אחריות משתמעת לסחירות, התאמה למטרה מסוימת, ואי-הפרה, ככל המותר על פי דין.

12. הגבלת אחריות

ככל המותר על פי דין, בשום מקרה לא נהיה אחראים לנזקים עקיפים, מקריים, מיוחדים, תוצאתיים או עונשיים, או לאובדן רווחים או הכנסות, הנובעים משימושך באפליקציה. סך אחריותנו לכל תביעה הקשורה לאפליקציה לא יעלה על 100 דולר ארה״ב או על הסכום ששילמת לנו ב-12 החודשים האחרונים, הגבוה מבין השניים.

13. שיפוי

אתה מתחייב לשפות אותנו ולפטור אותנו מכל תביעה, דרישה או נזק שינבעו מהפרה של התנאים או משימוש לא נכון באפליקציה.

14. דין שיפוט ופורום

על התנאים יחולו דיני מדינת ישראל, ללא התחשבות בכללי ברירת הדין. כל מחלוקת תיפתר באופן בלעדי בבתי המשפט המוסמכים בתל אביב, ישראל, אלא אם חוק כופה להגנת הצרכן בארצך דורש אחרת.

15. שינויים

ייתכן שנעדכן את התנאים. שינויים מהותיים יוכרזו באפליקציה בהפעלה הבאה. שימוש מתמשך לאחר העדכון מהווה הסכמה לתנאים המעודכנים.
